$130,000 – $250,000 (salary dependent on qualification and experience)

About the Role

As a Patent Attorney or Patent Agent at EIP, you will take a leading role in the drafting and prosecution of high-technology patent applications before the USPTO. The primary focus of the role is software and artificial intelligence – two of the most dynamic and commercially important technology areas in the patent landscape – with additional opportunities to contribute to opinion, validity, and pre-litigation work.

You will work directly with clients and inventors, managing a docket of matters from application through all stages of USPTO prosecution, and collaborating with colleagues across EIP's European offices to service our international client portfolio. What You'll Do

  • Draft and prosecute software and AI patent applications before the USPTO from initial filing through allowance

  • Respond to office actions, including preparation of claim amendments, arguments, and Examiner interviews

  • Manage PCT applications and coordinate with foreign associates on international prosecution and national phase entries

  • Assist with freedom-to-operate (FTO), patentability, validity, invalidity, and infringement/non-infringement opinions

  • Support pre-litigation, ex parte reexamination, reissue, and other post-grant work as it may arise

  • Build and maintain direct client relationships, including inventor meetings, portfolio reporting, and strategic IP counseling

  • Contribute to business development and help grow EIP's Denver-based US practice

What You'll Bring

We're looking for someone proactive, technically sharp, and ready to make an impact. You'll bring:

  • Registration to practice before the USPTO (patent agent or patent attorney)

  • A Bachelor's degree (BS) in a relevant technical discipline such as physics, electrical engineering, or computer engineering/computer science, combined with strong, relevant technical experience

  • Experience with physics-based inventions such as quantum computing is advantageous

  • Experience using AI tools in patent practice is viewed favorably, as is exposure to other emerging technology areas

  • 2–5 years of practical experience in patent drafting and prosecution, including substantive experience in software and AI patents

  • For attorney roles: J.D. from an accredited US law school and state bar admission (or eligibility)

  • Strong legal drafting skills with the ability to write technically precise and strategically positioned claims

  • Excellent organization, attention to detail, and ability to manage a busy docket under deadline pressure

  • Confident, direct communication skills with clients, inventors, and cross-functional colleagues

  • Collaborative mindset and enthusiasm for working within an international team

Compensation & Benefits

We offer a competitive compensation package designed to attract the best talent in the market:

  • Salary: $130,000 – $250,000 (dependent on role, qualification, and experience)

  • Benefits include medical, dental and vision coverage; a 401(k) plan with employer match; life, AD&D, short-term disability (STD) and long-term disability (LTD) insurance; generous PTO and paid holidays; and discretionary bonus potential.

  • Fully remote working available if preferred – with the option to use our Denver office and dedicated workspace if desired
