Oppositions & Challenges Experience

The Unified Patent Court (UPC) is also now gaining traction in Europe and increasingly interacting with EPO opposition practice. Whether defending a granted patent or challenging one, success depends on experience, precision and a deep understanding of the process.

EIP's mixed practice and depths of experience in EPO oppositions, as well as UPC and national litigation make us the firm of choice for clients seeking representation in these proceedings across all technical areas.

Our engineering practice, EIP Dynamics, combines deep technical expertise with commercial insight to help mechanical and electrical engineering clients secure patent protection, navigate complex IP landscapes and unlock the full value of their innovations.

As a team, we pride ourselves on our commercial knowledge, which we've gained from in-house experience. Our business acumen allows us to support clients with patent advice for specific commercial needs. Whether it's part of a 5-, 10- or 15-year strategic plan, we work closely with start-ups, SMEs, and multinationals to:

  • Secure strategic patent protection
  • Defend patent rights
  • Manage third-party IP risks
  • Support IP due diligence during investment rounds
  • Analyse competitors commercial and IP filing activity
  • Secure investments/funding
  • Maximize technology and extract value through invention mining
  • Stay ahead of competitors and gain market share

By taking a long-term view, we help future proof our client's IP portfolios, so they remain valuable for as long as possible.

How we helped Pulpex complete Series D funding

IP and its protection are central to the strategy of packaging technology company, Pulpex Limited.

We advise Pulpex's senior leadership team on IP strategy, protection and risks and IP-related agreements, providing patent attorney secondees as a pseudo in-house IP function, and undertaking the work required to protect the company’s technology using patents, trade secrets and registered designs. Our secondees keep up to date with Pulpex's technical and commercial developments and regularly check in with their scientists and engineers and inspect machinery to keep track of evolving processes.  Our team readily understand how Pulpex's innovations work, spot developments that are significant from a technical and/or commercial point of view and are well versed in asking the right questions to obtain the information needed to protect the IP. Pulpex’s portfolio now includes hundreds of patent rights, each drafted and prosecuted by EIP, spanning jurisdictions across six continents.

During a Series D investment round, we helped Pulpex answer numerous far-reaching questions on their IP in a due diligence exercise.  This included detailed examination of the scope and validity of several of their patent applications and a review of their freedom to operate in view of third-party IP rights.  Pulpex were able to demonstrate that their IP position was solid, which helped them secure £62 million in funding to finance the construction of their first commercial-scale manufacturing facility and create the UK's first fibre bottle supply chain.

The potential far reaching impact of Pulpex’s technology, and the way we help them protect it to ensure they are a viable business, has led to them being nominated twice for an Earthshot prize: first by CIPA and then by the competition organisers themselves.

Beyond Borders: A Backpacker’s Take on Why Your Patent Strategy Needs a Global Mindset
29 September 2025
In today’s interconnected world, innovation rarely stops at borders. Whether you’re a multinational corporation or a UK-based business with global ambitions, your patent strategy should reflect the reality that your products, services, and competitors operate internationally. Much like a well-travelled backpacker planning a round-the-world adventure, businesses must prepare carefully—mapping out routes, anticipating local rules, and packing what’s essential—to ensure a smooth journey.

In this episode of EIP Talks, Mark Lubbock and Ellen Keenan O'Malley, solicitors at EIP, explore the full lifecycle of intellectual property, from the initial spark of innovation to the commercialisation of ideas. They share practical insights into how we support clients through the challenges of protecting, developing and monetising IP.The conversation covers how clients typically engage with us, the importance of identifying and securing various forms of IP, and the legal strategies needed to navigate collaborations, ownership, and licensing. It also highlights the significance of well-drafted contracts, website compliance and investor readiness. Whether you're launching a new product, entering a partnership, or preparing for investment, this episode offers valuable guidance on building a strong IP foundation and turning innovation into commercial success.
